• “Free Users” refers to users on our free tier
• “Services” includes our App, Website, and all related services
• “AI Models” refers to the artificial intelligence technologies we use

Eligibility and Account Registration

Age Requirement

To use our App or Website, you must be at least 13 years old. If you are under 18, you must have obtained the consent of your parents or guardian and be under the supervision of a responsible adult to use our Platform.

Account Creation

Certain features of our App require you to create an account. During account creation, you agree to:

• Provide accurate and complete information
• Keep your information up-to-date
• Maintain the security of your account credentials
• Supervise all activities under your account
• Notify us immediately if you suspect unauthorized access
• Be responsible for all activities that occur under your account

If you have not used your Account for an extended period of time (12 months or more of inactivity), we may close and permanently delete your Account. You acknowledge and agree that this means you will lose any Content you generated. We will notify you via the email address you provided when creating your Account prior to deleting your Account.

Third-Party AI Services and Licensing

AI Technologies

Our Services integrate various artificial intelligence technologies to generate content including text, images, and other media. These AI services are provided by established third-party providers under their respective terms and licenses.

You acknowledge and understand that AI-generated content:

• May contain inherent biases or limitations
• Could produce unexpected or inaccurate results
• May resemble existing content
• Is provided “as is” without warranties

Third-Party Compliance

By using our Services, you agree to comply with:

• All applicable third-party terms and licenses
• Our acceptable use policies
• Platform-specific terms (Apple App Store or Google Play Store)
• All applicable laws and regulations

License Grant and Restrictions

Upon your adherence to these Terms, we provide you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and utilize our App for non-commercial use on devices that you own or manage. The same applies to the access and use of our Website.

The following actions are not permitted:

• Replicating, modifying, or creating derivative works of our App or Website
• Reverse engineering, decompiling, or disassembling our App or Website
• Altering or removing copyright, trademark, or other proprietary rights notices
• Licensing, renting, leasing, or transferring your rights to any third party

Content and Intellectual Property

Definition of Content

When you submit any material or data to the Service, it is termed as “Input”. The resulting creation or product from our Services based on your Input is referred to as the “Output”. Together, both Input and Output are addressed as the “Content”.

Content Ownership

Premium Users

If you’re subscribed to a paid tier:

• You maintain complete ownership, including copyright and all associated intellectual property rights, of the books you generate
• Books you keep private will only be accessed by us for service delivery purposes
• If you make books public, Storytime AI obtains perpetual global rights to display, adapt, distribute, and use the content for service enhancement, promotion, and other related purposes
• Other users can interact with your public content within platform functionalities

Free Users

Content created by users on our free (Basic) tier:

• Is public by default
• Grants Storytime AI comprehensive rights to utilize and commercialize the content
• Provides you a global, non-exclusive, royalty-free license to use your generated content for personal or commercial purposes
• Can be interacted with by other platform users as the platform allows

Service Delivery and Content Usage

• We retain the right to access and use your Content for service delivery and legal compliance
• This right remains even after agreement termination
• Machine learning usage: We can use your Content to improve our Services unless you enable privacy settings
• Advertising: Non-private content may be used for promotional activities
• Public Content: May be viewed and used by our community within platform limitations

AI-Generated Content Disclaimers

You acknowledge that:

• Output may resemble creations of other users
• Similar or identical content may be generated for different users
• Content may contain inherent biases or limitations
• We provide no warranties regarding uniqueness or originality
• You are responsible for evaluating content accuracy and appropriateness

Social Media Sharing

You may share your created content on social media platforms, however:

• You are solely responsible for compliance with applicable laws
• Sharing must not infringe upon others’ rights
• Violations may lead to account termination
• You must comply with these Terms when sharing

Subscription Plans and Credit Packages

Available Plans

We offer:

1. Basic Plan:
   • Complimentary Basic Plan
   • Public content by default
2. Premium Subscription:
   • Monthly or annual billing options
   • Monthly quota of credits
   • Unused credits roll over (up to double monthly allocation)
   • Option for private content
   • Additional features as specified on our Platform
3. Additional Credit Bundles:
   • Available to Premium subscribers
   • Various package sizes
   • No expiration date unless specified

Payment Processing

All payments for Premium Plans and Credit Bundles are processed through:

• Apple App Store (iOS users)
• Google Play Store (Android users)

You must comply with respective platform payment terms and conditions.

App Store Specific Terms

Apple App Store Users

1. These Terms are between you and Storytime AI only, not with Apple Inc. (“Apple”)
2. Your license is limited to Apple-branded products you own or control
3. Apple has no maintenance or support obligations
4. For warranty claims:
   • You may notify Apple for refunds
   • Apple’s liability is limited to the purchase price
   • All other warranties are our responsibility
5. Apple is not responsible for addressing claims about the App
6. Apple is a third-party beneficiary of these Terms
7. You represent that you are not in a US-embargoed country

Google Play Store Users

1. These Terms are between you and Storytime AI only, not with Google LLC (“Google”)
2. You must comply with Google Play’s Terms of Service
3. Google has no support or maintenance obligations
4. Refunds are subject to Google Play’s policies

Refunds and Data Sharing

Refund Requests

• App Store purchases must be submitted through Apple’s App Store
• Google Play purchases must be submitted through Google Play
• Decisions are made by the respective platform

Data Sharing for Refunds

We may share with Apple/Google:

• Purchase dates and times
• Content access logs
• Usage metrics and statistics
• Device information
• Transaction history
• Account status
• Progress tracking data

This data sharing is solely for:

1. Validating refund eligibility
2. Preventing fraudulent requests
3. Complying with platform policies

Referral Program

Our referral program rewards both referrers and referees:

• Referrers earn free credits for successful referrals
• Referees receive credits upon Premium subscription purchase
• Benefits require registration through unique referral link
• Credits may be forfeited if subscription is canceled within specified period

Misuse of Services

As a user of Storytime AI, you agree not to misuse our AI models. Prohibited actions include:

Specific Prohibitions

You must not generate content that includes:

1. Harmful representations of individuals, groups, cultures, or religions
2. Explicit sexual content or non-consensual acts
3. Child exploitation or inappropriate content involving minors
4. Animal cruelty or harm
5. Hate speech or discrimination
6. Content that endangers safety or well-being

Enforcement

Violations may result in:

• Immediate account termination
• Content removal
• Access restriction
• Potential legal action
• Credit forfeiture

Content Filters and Adult Responsibility

Content Filtering

• We employ filters for age-appropriate content
• We cannot guarantee universal content standards
• Adults must review content before sharing with children
• Report inappropriate content immediately

Adult Supervision

Adults are responsible for:

• Reviewing all generated content
• Ensuring age-appropriate usage
• Monitoring children’s access
• Reporting concerns promptly

Data Usage and Privacy

This applies regardless of legal theory and whether we’ve been informed of damage possibility.

Liability Caps

To the maximum extent permitted by law:

• Our total liability is limited to fees paid in the past 12 months
• We are not liable for free user damages
• Individual claim amounts are capped
• Technical issues liability is limited

Disclaimer of Warranties

The App and Website are provided “as is” and “as available” without warranties of any kind. We do not warrant that:

• The App will be error-free
• Defects will be corrected
• The App is virus-free
• Service will be uninterrupted
• Content will meet your requirements
• AI-generated content will be unique or original

Indemnification

You agree to defend, indemnify, and hold harmless Storytime AI from:

• Content violations
• Illegal activities
• Third-party claims
• Misuse of Services
• Breach of representations

Changes to Terms

We may revise these Terms periodically. For significant changes:

• Continued use indicates acceptance
• You may terminate if you disagree

Force Majeure
