Welcome to Storytime AI, your ultimate companion for creating captivating stories. The following Terms of Use (“Terms”) regulate your access to and use of the Storytime AI app (“App”) and our website, www.storytimeaiapp.com (“Website”), including any related services provided by us. By using our App or Website, you signify your agreement to these Terms. If you disagree with these Terms, kindly refrain from using our App and Website.

Eligibility
To use our App or Website, you must be at least 13 years old. By engaging with our services, you declare that you have reached the requisite age and possess the authority to accept these Terms.

Account Registration
Certain features of our App may require you to create an account. During account creation, you agree to provide accurate and complete information. You bear the responsibility of safeguarding your account credentials and supervising all activities under your account. Kindly notify us immediately if you suspect unauthorized access to or use of your account.

License Grant and Restrictions
Upon your adherence to these Terms, we provide you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and utilize our App for non-commercial use on devices that you own or manage. The same applies to the access and use of our Website.

The following actions are not permitted:

1. Replicating, modifying, or creating derivative works of our App or Website;
2. Reverse engineering, decompiling, or disassembling our App or Website;
3. Altering or removing copyright, trademark, or other proprietary rights notices on our App or Website;
4. Licensing, renting, leasing, or transferring your rights in our App or Website to any third party;
5. Utilizing our App or Website for any illicit or unauthorized purpose;
6. Using our App or Website in a manner that breaches any applicable laws or regulations.

The App is enabled by SDXL 1.0 model under the CreativeML OpenRAIL++-M License.

Content and Intellectual Property

1. Definition of Content: When you submit any material or data to the Service, it is termed as “Input”. The resulting creation or product from our Services based on your Input is referred to as the “Output”. Together, both Input and Output are addressed as the “Content”.
2. Ownership of Content for Premium Users: If you’re subscribed to a paid tier, you maintain complete ownership, including copyright and all associated intellectual property rights, of the books you generate.
   • Books you decide to keep private on Storytime AI will only be accessed by us for service delivery purposes.
   • If you make your books public, Storytime AI obtains perpetual global rights to display, adapt, distribute, and use the content for service enhancement, promotion, and other related purposes. However, other users of the platform can also interact with your public content, but only within the functionalities allowed by the platform.
3. Rights for Free Tier Users: Content created by users on our free tier (which is public by default) grants Storytime AI comprehensive rights to utilize and commercialize the content. In return, free users receive a global, non-exclusive, royalty-free license to access and use their generated content for personal or commercial purposes. Just like with premium users, other platform users can interact with these public creations as the platform allows.
4. Service Delivery and Compliance: Irrespective of your subscription type, Storytime AI retains the right to access and use your Content to ensure smooth service delivery, adhere to legal obligations, and enforce our terms and policies. This right is perpetual, even if our agreement is concluded or terminated.
5. Uniqueness Concerns: Given the nature of AI and machine learning, the Output may sometimes resemble creations of other users. It’s possible for Storytime AI or other users to generate similar or identical content.
6. Enhancing Our Services: Machine learning thrives on data for improvement. By using Storytime AI, you agree that we can use your Content to refine and enhance our Services. However, if you engage the privacy settings on the Generations page, your Input and Output will be exempted from this use.
7. Advertising and Promotion: If you decide not to set your content to private, we obtain a non-exclusive license to use your Content for advertising and promotional activities, including featuring it on our website.
8. Visibility of Public Content: Any non-private Output might be viewed and potentially used by Storytime AI or its community in ways that might transform or derive from the original.

You are allowed to share the content you create on social media platforms. However, you are solely responsible for ensuring that the content you share adheres to the laws applicable in your region and does not breach these Terms. Please note that sharing content that infringes upon the rights of others or violates any laws or these Terms may lead to termination of your account.

Misuse of Services
As a user of Storytime AI, you agree not to misuse our AI models, which are instrumental in generating text and images for stories. Misuse includes, but is not limited to, the following actions:

• Intentionally creating or distributing images or text that would create hostile or alienating environments. This may involve generating content that could be reasonably seen as disturbing, distressing, or offensive.
• Producing content that perpetuates historical or contemporary stereotypes or bias. This includes generating demeaning, dehumanizing, or otherwise harmful representations of individuals, groups, environments, cultures, religions, etc.
• Utilizing the AI models to knowingly propagate discriminatory content, harmful stereotypes, or contribute to the impersonation of individuals without their express consent.
• Sharing or creating content of a sexual nature without the consent of all potentially involved or affected individuals.
• Misusing the AI models to generate or distribute misleading or false information (mis- or disinformation).
• Creating or disseminating representations of extreme violence, gore, or any content that may inflict emotional harm or distress on viewers.
• Sharing copyrighted or licensed material in violation of its terms of use or creating derivative content from copyrighted or licensed material without adherence to its specific terms of use.

Infringement of these provisions may result in immediate termination of your account and access to our services, and potential legal action. By using Storytime AI, you agree to abide by these rules and acknowledge the potential consequences of violation.

Subscription Plans and Credit Packages

We offer two distinct plans to accommodate varying user preferences and ambitions.

• Explorer Plan: This complimentary Basic Plan offers one (1) initial non-expiring credit.
• Premium Subscription: We offer a singular Premium tier, which can be billed on a monthly or annual basis. This plan grants a monthly quota of credits, with the benefit of rolling over unused credits up to a limit of double the monthly allocation.

Additional Credit Bundles: Premium subscribers can further enhance their experience by purchasing additional Credit Bundles.

Please be aware that all payments for our Premium Plans and Credit Bundles are processed through in-app purchases on the Apple App Store or Google Play Store. By selecting a Premium Plan or purchasing Credit Bundles, you agree to abide by the terms and conditions of the respective app marketplace, which includes their policies on subscription management, refunds, and dispute resolution. These processes are largely managed by the respective app store, and as such, any queries or concerns related to payment processing, refunds, or subscription management should be directed to the appropriate app store’s support. Please ensure you understand and accept these terms and conditions prior to making any in-app purchases.

Referral Program
Our referral program rewards you and your referred friend. As the referrer, you earn free credits for each successful referral. Your referred friend, or the referee, gets free credits when they purchase any Monthly or Annual Premium Subscription plan.

Referral benefits can only be claimed if the referred user registers an account using your unique referral link and subscribes to a Premium Plan. If the referred user cancels their Premium Subscription within a specific period (as determined by us), the referral credits may be forfeited.

Content Filters and Adult Responsibility
We employ content filters to ensure stories and images generated within the App are suitable for all ages. However, we cannot guarantee every piece of content will meet everyone’s standards or be appropriate for all children. Adults are tasked with reviewing all stories produced by the App before sharing them with children. If you encounter any content you believe is inappropriate or contravenes these Terms, please report it to us for review.

Termination
We reserve the right to revoke your access to the App, and delete your data without notice if you violate these Terms or if we reasonably believe that your actions may inflict harm upon us, other users, or our services.

Changes to Terms
We may revise these Terms periodically. If we make any significant changes, we will notify you through the App, Website, or by email. Your continued use of the App or Website after such changes are enacted signifies your acceptance of the revised Terms.

Governing Law
These Terms are governed by the laws of the State of Delaware, disregarding its conflict of law provisions. Any disputes arising from these Terms or your use of the App or Website shall be exclusively addressed by the courts located in the State of Delaware.

Limitation of Liability
In no event shall Storytime AI, its affiliates, officers, directors, employees, agents, or licensors be liable for any damages, including but not limited to loss of profits, data, use, or goodwill, arising from your access to, use of, or inability to use the App or Website, to the maximum extent permitted by applicable law. This includes damages based on warranty, contract, tort (including negligence), or any other legal theory, regardless of whether we have been informed of such damage.

Disclaimer of Warranties
The App and Website are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App or Website will be error-free, that defects will be rectified, or that the App or Website or the servers that host them are free of viruses or other harmful components.

Indemnity
You agree to defend, indemnify, and hold harmless Storytime AI, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the App or Website.

Severability
If any provision of these Terms is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Waiver
No waiver of any provision of these Terms shall be considered a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms does not constitute a waiver of such right or provision.

Entire Agreement
These Terms, along with any other agreements or policies incorporated by reference, represent the entire agreement between you and Storytime AI regarding your use of the App and Website and supersede any prior agreements or understandings, whether oral or written, relating to the subject matter herein.

Assignment
You are not allowed to assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer without such consent will be deemed null and void. We may freely assign or transfer these Terms without restriction, and the transferor or assignor will not remain jointly and severally liable.

Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to, acts of God, war, terrorism, civil unrest, strikes, labor disputes, accidents, or governmental actions.

Third-Party Links
The App and Website may contain links to third-party websites or services that are not owned or controlled by Storytime AI LLC. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. By using the App or Website, you expressly release Storytime AI LLC from any and all liability arising from your use of any third-party website or service.

Privacy
Your use of the App and Website is subject to our Privacy Policy, which is incorporated by reference into these Terms. By using the App or Website, you acknowledge and agree that you have read and understand our Privacy Policy and consent to the collection, use, and sharing of your information as described therein.

Notices
All notices or other communications required or permitted under these Terms shall be in writing and shall be deemed given when delivered personally, sent by email, or posted on the App or Website.

Headings
The headings in these Terms are for convenience only and have no legal or contractual effect.

Interpretation
In these Terms, the words “include,” “includes,” and “including” shall be deemed to be followed by the words “without limitation.”
